§ 1 Scope
(1) The following general terms and conditions (hereinafter referred to as “GTC”) apply to purchase contracts via the online shop between the city of Lienz (hereinafter: Bruck Castle Museum) as the seller and you as the buyer (customer).
(2) By placing the order, you declare that you agree to these terms and conditions.
(3) If individual provisions of these General Terms and Conditions contradict mandatory legal regulations in whole or in part, the remaining provisions of these General Terms and Conditions remain valid.
§ 2 Purchase contract
(1) All offers in the online shop of the Museum of the City of Lienz Schloss Bruck are an invitation to you to make an offer.
By clicking on the “BUY” button to complete the ordering process, you are making a binding offer to conclude a purchase contract with the Museum of the City of Lienz Schloss Bruck.
We will automatically confirm receipt of your order on the following website. You will then receive an email from us confirming acceptance of the offer (confirmation email) and the invoice will be sent. This concludes the purchase contract between the Bruck Castle Museum and you.
It is emphasized that goods are only dispatched against payment in advance.
Your order data will be saved by us. If you would like to keep this for yourself, please print out the confirmation page.
It is noted that no purchase contract is concluded for products from the same order that are not listed in the shipping confirmation. The Schloss Bruck Museum is entitled to reject your order in whole or in part due to unexpected circumstances (e.g. delivery difficulties, unavailability of the goods). Once we become aware of such circumstances, we will inform you immediately by email. If you have already made advance payments for the goods that were not delivered, we will of course refund you these.
(2) Contract language:
The content of the contract, all other information and customer service are provided exclusively in German.
§ 3 Purchase price
For the items ordered in the online shop of the Museum of the City of Lienz, only the prices that are displayed in the shopping cart immediately before sending the order apply. The prices include the statutory VAT for Austria. Price changes before ordering as well as input and electronic transmission errors are reserved.

If you make the transfer from a foreign bank institution within the EU, you will not incur any additional costs if you provide the SWIFT and IBAN codes. In all other cases, you will be responsible for the money transfer fees.
§ 4 Shipping
The shipping costs stated in the order apply. Shipping is currently only possible in Austria and Germany.
§ 5 Delivery
The Museum of the City of Lienz Schloss Bruck endeavors to ship all items in stock within 30 days of receipt of your order. If certain items are not immediately available due to high demand, you will be notified of the expected delivery period. If the specified delivery deadline cannot be met in this case, we will contact you immediately to agree with you whether the order should be maintained.
§ 7 Warranty and Damages
The Museum of the City of Lienz Castle Bruck ensures that the items delivered to you correspond to the order. Slight deviations in the goods do not constitute a defect that triggers a warranty claim. Despite the greatest possible care, errors in the products cannot be ruled out. The statutory warranty provisions apply. Claims for damages by the customer, in particular compensation for consequential damages or loss of profit due to defective, omitted or delayed delivery, withException of personal injury, only exist if the damage is based on gross negligence or intent.
§ 8 Right of withdrawal for consumers in distance selling:
(1) Consumers within the meaning of the Consumer Protection Act (hereinafter: “KSchG”) can withdraw from the concluded contract or the contractual declaration made without giving reasons, subject to a notice period of 7 working days (excluding Saturdays).
It is sufficient if the declaration of withdrawal is sent within the deadline. For contracts for the delivery of goods, the withdrawal period begins on the day they are received by the consumer.
(2) The goods must be returned to the seller in an unused, resalable condition and in the original packaging. For items that show signs of wear or whose packaging is damaged, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when goods are returned.
(3) In the event of withdrawal, a full or partial refund of the purchase price will only take place step by step against the return of the goods received. The return shipping costs are borne by the customer.
§9 Data protection
Your personal data and all other information about your order are encrypted and transmitted over a secure connection.
We store your name and address as well as order-related data. Of course, we guarantee you comprehensive protection of your personal data in accordance with the provisions of the Data Protection Act. Your data will only be passed on to third parties as part of the fulfillment of your order, e.g. for any necessary address checks.
We strive to constantly improve the range and service of the Museum of the City of Lienz Schloss Bruck for you. Regular evaluations of customer and order data contribute to this. § 10 Final Provisions
(1) Austrian law shall apply exclusively, excluding national and supranational reference norms (Rome I Regulation) and the United Nations Convention on Contracts for the International Sale of Goods (UN Sales Law).
(2) The place of contract and performance is Lienz. If a customer is a consumer within the meaning of the KSchG, the court with jurisdiction for any legal disputes is the one in whose district the customer"s residence, habitual residence, or place of employment is located. In all other cases, the local and substantive jurisdiction of the Lienz District Court is agreed upon.
(3) Amendments and supplements to these GTC as well as all contracts concluded on their basis can only be made in writing.
